Cloth Masks Disclaimers
We ask that all people interested in purchasing and using cloth masks made by Plaid Peach Clothing and Costumes by Denny read and understand the following disclaimers. Most importantly, we are not manufacturers of medical grade products, if you require a medical grade product, please consult a medical professional.
1 – Cloth Masks (hereafter referred to as “the product” or “masks”) manufactured by Plaid Peach Clothing and Costumes by Denny (hereafter referred to as “we,” or “the sellers,” or “the manufacturers.”) are not sterile medical devices. We do not make medical claims in regard to the use of our masks. Please consult your medical professional to learn more about medical masks and how you can obtain one. We do not take any responsibility if our masks are used for purposes they were not created for.
1.1 – We cannot guarantee the effectiveness of our masks against Coronavirus, COVID-19, or any other airborne pathogens.
1.2 –We are manufacturing masks in accordance with the reccomendations of the CDC released in regard to the COVID-19 pandemic. 1.3 – Our masks are made using high quality materials as recommended by the CDC and other independent hospitals and studies.
2 – Masks must be fitted and worn properly to provide any nominal protection.
2.1 – We will provide basic fitting, donning, and doffing instructions based on available best practices.
2.2 – Provided instructions are not intended to be medical advice and do not guarantee effectiveness of our product. Please consult a medical professional if you have questions about fit and usage.
3 – Per CDC: Cloth face coverings should not be placed on young children younger than 2 years of age, anyone who has trouble breathing, or is unconscious, incapacitated or otherwise unable to remove the cover without assistance. Placing masks on infants or persons who cannot remove the mask without assistance poses a serious risk of suffocation or asphyxiation. Should you require protection for an infant or person such as aforementioned, please contact a medical professional.
3.1 – Children’s masks are only to be used by children 2 and up, and under direct supervision of an adult.
3.2 – Under no circumstances should this product be used on an infant.
4 – Masks must be cleaned regularly and properly to provide any nominal protection.
4.1 – We will provide care instructions for cloth masks.
4.2 – Provided care instructions are not intended to create sterile medical devices. Consult a medical professional if you need a sterile product.
5 – Buyers agree to observe and obey all posted and printed instructions and warnings, and further agree to follow any additional instructions given by the sellers or their agents.
6 – Buyers recognize that there are certain inherent risks associated with the use of cloth masks and assume full responsibility for personal injury or illness of the buyer and (if applicable) buyers friends and family members. Buyers further release and discharge the seller for injury, illness, loss, or damage arising out of buyer or buyer’s friends and family’s use of the products provided by the seller, whether caused by the fault of the buyer, buyer’s family or friends, or other third parties.
7 – In no case shall Costumes by Denny or Plaid Peach Clothing, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, or injury to body whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the product, or for any other claim related in any way to your use of the product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the product, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
8 – By making a purchase from the seller, buyers agree to all of the above terms.
